Cleaning stirs up the dust

I’m still exploring the need to revisit this paperwork, especially in this manner. Some of it is remembrance, some of it is to help me more fully establish a timeline, given the levels of agony I was in at the time.

COMPLAINT

Now comes plaintiff herein and complaining of the defentant alleges and says:

  1. At least one of the parties hereto is a resident of the State and has been for more than six months next preceding the filing of this complaint.
  2. The parties herein were married on or about August 21 in IDBD City , and have lived continuously separate and apart since on or before July 31 and have at no time since resumed the marital relationship.
  3. There were no children born of the marriage.
  4. Plaintiff desires that counsel represent plaintiff for the purposes of obtaining a divorce only and he withdraw upon the entry of judgement.

Wherefore plaintiff prays the Court as follows:

  1. The plaintiff be granted an absolute divorce.
  2. The court accept this verified complaint as an affadavit for the purpose of granting Summary Judgment if Summary Judgment is requested.
  3. For such other relief as to which plaintiff may be entitled and plaintiff’s counsel be allowed to withdraw upon entry of judgment.

I signed the paperwork and sent it back in. No response, no argument, just fix it so I can legally have my name back. And never ever EVER change it again. Now, though, you get my response:

RESPONSE

  1. I have no clue if this is a true statement or not, so we’ll call it admitted. I left the State more than six months after he left me.
  2. Denied. We were married on July 20, in another county. The police report*/souvenir is dated March 6, and I never saw him again after that.
  3. Thank god.
  4. Wow, this attorney must REALLY want your continued business.

*Police Report Narrative: At 1947 I responded to the [censored] along with [censored] in reference to an attempted suicide call. The caller stated that her husband had a gun with him and was threating (sic) to kill himself.** The caller gave out a description for a van that would be parked at [censored]. I located the vehicle in front of the [censored]. We four officers (verbiage mine) were standing by in various locations awaiting Mr. X to come to his vehicle. Officer [censored] spoted (sic) Mr. X approaching his vehicle and Officer [censored] stopped the vehicle. Mr X had a .357 magnum on the dashboard which was seized at the scene. Mr. X had a hunting knife and two boxes of ammo that were also siezed at the scene. The seized items were placed into property control. We escorted Mr. X to The Hospital for observation.***

**What the officer wrote and what I told him are entirely two different things. To be precise, what I said was: “Mr. X packed his things and drove off. He then called and said he was parked at [censored]. He told me he would leave his debit card in the unlocked vehicle, and that I was to take it and then “It would all be over with.” I do not know what he meant by “It will all be over with”, but he has a gun with him and I’m not taking any chances. He is hypoglycemic, hasn’t eaten in well over 24 hours, and is not rational.

***To the best of my knowledge he left The Hospital AMA in the company of the woman he was cheating on me with.
